Madrid Spain.- A man was tried this Tuesday by the Fourth Section of the Provincial Court of Valenciafor removing the condom without the consent of the other person during a sexual relationship.
The defendant, a Ghanaian national, faces a sentence of 7 years in prison for the crime of rape committed, according to the Provincial Prosecutor’s Office, by removing the condom during a relationship that was initially consensual.
The subject without a criminal record and in a legal situation in Spain, met the victim of Dutch nationality, on October 21, 2021 in a nightclub in Valencia.
They both decided to go to the man’s house and the woman let him know that in order to keep sexual intercourse he should use a condom.
Although the man initially agreed, once they began the sexual act, the man removed the condom without the woman’s consent “in one quick movement” and continued with the penetration.
Realizing this, the woman tried to get away, but the man held her tightly by the shoulders and didn’t stop until he ejaculated inside her.

In the prosecutor’s opinion, these facts are constitutive of a crime of rape for which he claims for the defendant a sentence of 7 years in prison and the payment of compensation of 6 thousand euros (120 thousand Mexican pesos) for moral damages.
