The Federal Tax Service (FTS) reminded Russians of changes in the calculation of tax in real estate transactions, changes in legislation came into force on January 1, 2022. The list is published on website FTS.
So, in the 3-NDFL declaration, it is now possible not to indicate income from the sale of real estate until the expiration of three or five years of ownership if the income from the sale does not exceed the amount of the tax deduction. This applies to citizens who have sold an apartment or house at a price below one million rubles.

“If the income from the sale of property exceeds the amount of deductions, the 3-NDFL declaration will still have to be submitted,” the Federal Tax Service noted. When acquiring rights to housing or its share in a house under construction, the right to a tax deduction arises from the moment the deed of transfer is signed by the developer.
In addition, families with children are exempt from paying personal income tax when selling real estate, regardless of the period of ownership of the property, but this provision only applies to income received from transactions in 2021.
The Federal Tax Service also explained the changes regarding the maximum minimum tenure of real estate acquired under an equity agreement. It is counted from the moment of full payment of the cost of the object under this contract. Thus, the moment of additional payment associated with an increase in the area of such an object after the house is put into operation is not taken into account.
Earlier, State Duma deputy Yevgeny Fedorov appealed to the head of the Ministry of Labor Anton Kotyakov with a request to exempt Russians from paying tax for individuals on the income of a transaction for the sale of inherited real estate. He recalled that according to Russian law, Russians have the right to sell inherited real estate only after three years of ownership of the property. This rule creates difficulties for heirs who already own their own housing and plan to part with the inheritance.
