The prosecutor of the DANA case supports the dismissal by the instructor judge of the complaint presented by the Ultra -Chanting Association to make against the Government delegate, Pilar Bernabé.
The representative of the Public Ministry, Cristóbal Melgarejo, recalls in a brief to which Eldiario.es has had access, in which the ex -manager Salome Pradas (investigated in the case) exercised, according to the current regulations, the address of the special plan against the risk of flood (Cecopi).
The prosecutor’s letter, on March 21, concludes that the Government delegate, the socialist Pilar Bernabé, can be charged, the “lack of adoption of decisions that would have avoided or attenuated the aforementioned result”, in reference to the 228 deaths and injuries.
The Public Ministry believes that Bernabé had entrusted the “strict coordination of the state administration with the autonomic” and was not “in the position of guarantor” nor had a “functional dominance of the risk.”
The brief, of March 21, reviews the emergency and civil protection legislation, which gives the Autonomous Administration the Single Command of the Catastrophe response in the emergency situation 2, in force on Dana Day.
Hazteoir resorted to the judge’s car that cited as investigated to former Conssellera Salomé Pradas and number two, the regional secretary Emilio Argüeso. The appeal claimed that the decision of the instructor to knock down the complaint against the president of the CHJ was “illogical and unreasonable”, as this newspaper reported.
The same association already crossed out of the instructor’s argument after “absurd” after a car on February 24 rejected the imputation of the Government delegate, to Bernabé.
