Revokes last Friday’s order after rejecting the political considerations denounced by the Association of Christian Lawyers, to whom it imposes the costs of the procedure
The head of the Contentious-Administrative Court number 30 of Madrid, Carmen Casado, has revoked this Friday the very precautionary measure issued a week ago by which she suspended the issuance by the Post Office of the commemorative stamp of the centenary of the Communist Party of Spain (PCE ).
The magistrate has ruled out the political consequences of the dissemination of this issue, alleged by the Association of Christian Lawyers, who is forced to pay the costs caused, and has given free rein for the issuance of the 135,000 stamps with a postal value of 0, 75 euros each, that is, 101,250 euros if they are all sold. A run initially scheduled for last Monday.
In an order, the judge alleges the “non-concurrence of the route in fact imputed to the action” of Correos, to whom Law 43/2010 attributes only functions of distribution and sale of postage stamps. On the other hand, in a resolution of October 28, jointly adopted by the body competent to approve this seal: the Undersecretaries of Transport, Mobility and Urban Agenda and the Treasury, agreed to authorize the issuance of the commemorative copy of the PCE, once followed the procedure legally established in Royal Decree 1637/2011 and this, taking into account that the aforementioned resolution “has not been the object of any challenge, becoming final and consented”.

For all of the above – the order concludes – “all doubts about the existence of the factual route adduced by the plaintiff, motivated by reasons of a political nature that do not deny or oppose the facts referred to and proven herein, are dissolved.”
The Association of Christian Lawyers considered in its appeal that the issuance of this stamp violated the duty of neutrality and objectivity of the Public Administrations included in the Constitution. The reason, they argued, is that “it supposes the exaltation of a political party that committed crimes and persecuted thousands of people solely because of their faith, for which reason issuing this stamp is contrary to the Law of Democratic Memory and the resolution of Parliament European Union that condemns the exaltation of communism”.
The president of Christian Lawyers, Polonia Castellanos, also considered “unacceptable” that the government asks “that we tighten our belts and then waste everyone’s money on imposing its ideology, exalting a party that committed crimes against Christians.” The foundation launched a collection of signatures on its website on Monday to ask the president of the Post Office to remove the stamp before it goes into circulation.
Against the order of this Friday there is an appeal in the same court, although the issuance of the 135,000 copies is already effective.
