The Labor Inspectorate determines that the main cause of the death of the butcher Santiago López in the corrals of the Plaza de Toros de Murcia on September 12 was “the lack of prevention measures at all of the personnel who carry out the work of puntillero in the slaughter procedure of a sombrero bull in the area of corrals called square”. That is one of the conclusions that the body embodies in a report, to which LA VERDAD has had access, and in which it draws up a record for two sanctions against the company Toros Sureste SA, which operates the bullring – and which appears in the criminal proceedings as subsidiary civil liability. He proposes a fine worth almost 5,000 euros.
This document from the Labor Inspectorate is already in the hands of the head of the Investigating Court number 7 of Murcia, who last December refused to shelve the investigation into the death of this butcher. The inspector explains, in the letter, that, despite the “multiplicity” of statements that he has been able to gather in this case, he has not been able to unquestionably conclude that there was an employment relationship that September 12 between the deceased and the aforementioned company. .
That day, he explains, López had gone to the plaza, without a ticket, along with other relatives to see the bullfight without actually serving as a butcher in the slaughterhouse. He highlights, however, his presence in the area because he had already provided this work on other occasions – the day before, without going any further. One of the witnesses questioned by the Inspection assured that the butcher had also been entrusted with the task that day, but the inspector assures that the assertion has not been confirmed by other voices.
At the end of the bullfight, the report explains, Santiago López assumed the responsibility of stabbing the bull “either individually or voluntarily or because someone has informed him or has requested it, an aspect that has not been clarified.”
No risks identified
At that moment, the document explains, the staff of the square gives the butcher a lace that neither he had on him nor was in the slaughterhouse. “It is clear that no butcher present that day wanted to assume this function and/or did not perform it in any case,” the report underlines.
The Labor Inspectorate points out, as the main cause of death, the lack of preventive measures. As a secondary cause, he points to “the lack of adequate evaluation of this procedure, inherent to the production process of the company that has to end with the death of the bull in the arena or in corrals, picking up the figure of puntillero in an ambiguous way since it would exist a de facto butcher for the show and a theoretical one for the butchers in corrals, carried out by butchers».
The document concludes that the evaluation carried out by the company “does not identify the risks existing in the slaughterhouse based on who is going to carry out the activity that, as can be deduced from the actions carried out, are carried out by butchers hired by the company”.
The private prosecution stresses that it was the firm that gave him the lace
The lawyer Evaristo Llanos, who exercises the private prosecution on behalf of the family of the deceased, positively values the analysis carried out by the Inspectorate and considers that it reinforces the theory maintained at all times by this party that there was no measure of security in the plaza. security. The lawyer also emphasizes the conclusion of the Labor Inspectorate that someone from the company should have given the butcher the lace to take care of the animal, since he did not have it on him or was in the slaughterhouse.
The private prosecution maintains that the puntillero —person who is in charge of finishing off the bull with the lace— is a mandatory figure in the bullrings and his work can only be carried out by specialized personnel. The company, however, has declared that there was no one in charge of that function.
In this procedure, a national police officer (who performed the function of the government delegate), the corralero of the Murcian arena and three employees of the firm appear as investigated.
