The Public Ministry of São Paulo defined this Saturday, 13th, the triple list for attorney general of Justice. The position was held for the last four years by prosecutor Mário Luiz Sarrubbo who, after two consecutive terms, retired in March to take over as National Secretary of Public Security at the Ministry of Justice.
The two candidates he supported, José Carlos Cosenzo and Paulo Sérgio de Oliveira e Costa, came in first and third place, respectively, with 1,004 and 731 votes.
The second place, with 987 votes, was prosecutor Antonio Da Ponte, from the opposition.
Voting opened at 9 am. In less than two hours, 74% prosecutors and prosecutors had already voted. At 3 pm, 98% of the votes were registered. The system is electronic.
The election ended at 5 pm and, within a few minutes, the result was announced.
“I would like to thank the candidates for the honesty with which they proceeded”, said acting attorney general Fernando José Martins when proclaiming the result.
The list with the three most voted candidates has already been sent to governor Tarcísio de Freitas (Republicans). He has 15 days to announce his choice.
Tarcísio is not obliged to name the first place winner. In other words, in practice, whoever wins the internal election does not necessarily take the position.
The São Paulo Public Ministry Association, which represents the state's prosecutors and prosecutors, sent a letter to the governor asking him to choose the candidate with the most votes.
Five prosecutors competed for the top of the institution. Paulo Sérgio de Oliveira e Costa and José Carlos Cosenzo had the support of the former attorney general. Sarrubbo was re-elected with the highest vote in the history of MP elections and reappointed in 2022.
After a sequence of disputes marked by fierce clashes, the opposition gave up a candidacy, and the prosecutor won without even facing competitive candidates, which made him an important electoral leader.
Prosecutors José Carlos Bonilha and Antonio Da Ponte ran in the opposition and prosecutor Tereza Exner, former inspector general of the Public Ministry, placed herself as an “independent” candidate.
In addition to managing the Public Ministry, the Attorney General of Justice is responsible for investigating state deputies, mayors and even the governor who appoints him.

The difference between first and second placed was 17 votes, that is, less than 1%.
According to the MP's electoral rules, each prosecutor can vote for three candidates. Around two thousand members of the institution are eligible to participate in the election.
