The approval of the sale of the telephone operator Oi Móvel to Claro, TIM and Vivo by Cade (Administrative Council for Economic Defense) left the company’s customers with doubts about how their contracts will be going forward.
In all, about 42 million customers should be impacted by the changes, which will not be immediate. It is important to highlight that the new operators of these cell phones will have to follow a series of rules defined by Anatel (National Telecommunications Agency).

1- How is the situation of customers?
With the sale, Oi’s customers will be migrated to one of the purchasing operators (Tim, Vivo, Claro), according to the division carried out by the purchasers themselves. The migration must occur with the guarantee of the consumer’s right to information.
2- Do I have to change operator?
Yes, but a period of 18 months was stipulated for the change. Since the new operators need to present a proposal for this migration to Anatel that contains a detailed communication plan for consumers.
3- Do I have to respect fidelity?
Oi customers, both mobile telephony and combos that contain mobile telephony, will no longer have the loyalty required in their contracts, even though the term has not yet expired.
4- Portability
The consumer may request portability to other operators free of charge at any time. If you do not carry out the portability, the automatic migration must occur to a plan similar to the one previously contracted for the consumer.
5- Will the values and services of the contracts already signed be maintained?
Consumer protection agencies argue that it is. However, there are no guarantees that the values will be maintained.
6- If Oi Móvel’s customers do not want to stay with one of the buyers, what is the appropriate procedure?
According to Anatel’s conditions, consumers have the right not to have automatic migration to Claro, TIM or Vivo. The information must be made available in the Communication Plan, which must be submitted within 90 days to Anatel’s Consumer Relations Superintendence.
7- With the change of operator, will my cell phone number change?
No. With the portability rule, the phone number can be used on any carrier.
