Former state deputy from Rio de Janeiro Alexandre Freitas (Podemos) was ordered to pay R$30,000 in compensation after a publication considered racist made on X (former Twitter) in 2020. The decision was made by the Rio de Janeiro Court. Here's the link for the sentence, issued on April 11.
In the case in question, Freitas was involved in a discussion about the freedom to carry and possess weapons in Brazil. The politician wrote a post as if someone were talking to him: “But deputy, what do you think of good people carrying rifles?”. Then he replied: “Hmmm, it depends, what color is it?”.
The decision states that, as Freitas' speech took place when he held an elected mandate, the position has “particular reprobability”.
“It is not possible to consider as protected by freedom of expression speeches that express conduct contrary to the law, such as incitement to racism or any other form of discrimination”says federal judge Mariana Tomaz da Cunha.
The amount paid by the former deputy will be allocated to the Federal Fund for the Defense of Diffuse Rights.
