“It is an unconstitutional sentence because it violates the principle of constitutional hierarchy of article 51 of the Constitution, which indicates that any son or daughter of a Peruvian is entitled to registration. Why can’t Ricardo Morán enroll his children in Reniec?
According to our Civil Code of Peru, the presence of the mother is needed to register a child and sign the birth certificate. “Since Law No. 28720 was passed in 1984, a single mother can register her child with her own surnames or with those of the alleged father,” reads Reniec’s page.
The legal vacuum of the Constitution does not include the parent, nor does it grant the same conditions. For this reason, Ricardo Morán indicated that he has presented the documents requested by Reniec in order to register his descendants, which were rejected.

“They made observations to us, we solved the observations. A few months later they told us no, we made an appeal, finally the appeal was denied. As the administrative channel is exhausted today (December 24) it is very important because today I am signing, in front of you, the amparo action in the Judicial Power, because it is time to judicialize the process, because it is time to go to the Power Court and say: ‘The constitutional rights of Emiliano and Catalina are being violated’”ended at the time through his Instagram stories.
