A commission of jurists created in September last year by the president of the Federal Senate, Rodrigo Pacheco (PSD-MG), will present on the 26th the text of the draft of the new Civil Code. The intention is to update this set of standards, which has been in force since 2002.
The specialized group met six times in total. Each meeting was attended by members of civil society and the law. The result of the debates was transformed into a report with more than 1,800 pages at the end of last year.
The professor of Civil Law at the Faculty of Law of PUC de São Paulo and rapporteur of the commission of jurists, Rosa Maria de Andrade Neri, said that the report is permeated with multiple new features. She explains that at this moment the commission is mining the riches of the text.
“We have a different job ahead of us, which is to amalgamate all these new ideas coming from academic and professional experience, and also from the vicissitudes of Brazilian economic life and the delicacies of life.”
For the president of the Federal Senate, Senator Rodrigo Pacheco (PSD-MG), the update of the Brazilian Civil Code aims to fill gaps caused by the new social relations of the digital era. The challenges, according to him, are to modernize the law, and, at the same time, guarantee legal security.
“We are always faced with the challenge of reconciling the need to update and modernize a statute, a law or a code with the need to preserve legal security, because in fact legal security is imposed on Brazil and it is mandatory to have it not only in the judiciary, but also in the Legislature”, he said.
The Civil Code is a set of rules that govern private law. In other words, this legislation regulates people's rights and duties, including their assets and relationships, such as birth, marriage, contracts, obligations and succession.
