A Court of Barcelona has annulled the confidentiality contract that the Dalas Review Youtuber made one of its ex -partners to prevent them from speaking in public of the relationship they maintained. This new lawsuit arose on initiative of Youtuber itself when it filed a claim of 40,000 euros against Anne Reburn, its ex -partner, for having breached a contract: that of confidentiality that, he alleged, had signed years ago and prohibited the young woman from talking about her sentimental life In common, something she had done in several videos. According to the Dalas version, they had previously signed another collaboration contract between their two channels.
The magistrate who has studied that claim, in a judgment of last December that has been able to examine Eldiario.es, has rejected the economic demand of Santomé and has accepted the request of his ex -partner, defended by the lawyer Javier Maestre, to cancel that contract. He explains, as his lawyer recognized during the process, that the YouTuber “made a confidentiality agreement to all his partners” but that, in this case, he was irregular and the only beneficiary was him. The agreement, among other things, forced the young woman and the YouTuber to only be able to reveal that “confidential information” with a written permit of the other and to cause “a positive and never negative impact” on the other.
“Limited knowledge” of Spanish
The sentence questions the version of the YouTuber and explains, in the first place, that its ex -partner did not dominate the use of Spanish, of which it had a “limited knowledge”, and doubt that it knew, therefore, the scope of what I was signing. A contract that, in addition, “was not signed in the unit of act” and that “does not bring cause in any verbal contract” prior to services. “It has no certain cause.” Sufficient irregularities, according to the magistrate, not only to reject the economic claim of Dalas, but to turn the lawsuit and cancel the contract.
The only objective of Dalas by signing this contract to his ex -partner, he explains, was to “protect” the plaintiff from “their sentimental and sexual relationships with couples.” “The only one who benefited from the signing of the agreement is the plaintiff, bringing the freedom of expression of the defendant, who could not talk about his relationship with him and must request authorization to do so.” The young woman, adds the judge, “lent her induced consent to error.”
The case has reached this court after, at first, another had effectively condemned the young woman for breaching that confidentiality agreement in one of her videos. That condemnation was revoked after the ex -partner of Dalas Review presented an incident of nullity and went not only to reject compensation for him, but also to request the nullity of the contract. The case has already been appealed by the YouTuber before the Provincial Court of Barcelona.
The agreement that the YouTuber gave to sign its then partner included a criminal clause that forced to pay compensation of 10,000 euros if one of the parties broke the confidentiality contract, an amount that should be multiplied by the number of breeding clauses.
