The plenary of the Superior Electoral Court (TSE) decided today (18) to bring forward the validity of the resolution, approved in August, which allows the collection of signatures via the internet for the creation of a new political party. By the decision, the standard is already in effect.
At first, the Resolution 23,647/2021 was to take effect just 120 days after it was approved on August 31st. However, the TSE already made available, on November 3, a tool that enables the collection of electronic signatures, which is why the ministers decided to bring forward the validity of the new standard.
The new Support System for Party in Formation (SAPF) allows new associations to collect signatures using digital certification, along the lines of the Brazilian Public Key Infrastructure (ICP-Brasil).
In this way, citizens who wish to support the creation of a political association can fill in a specific form manually or electronically, as long as they have digital certification. The parties in formation continue to be the only ones able to collect and present signatures to the Electoral Court, whether in physical or electronic form.
The resolution also provides that, in addition to certification via ICP-Brasil, signatures in support of the creation of a party may be collected through the e-Title app, which has a wider reach, as it has been downloaded by more than 20.5 million voters. This possibility, however, is still being developed by the TSE.
One of the requirements for the creation of a new party is popular support, with the collection of signatures from a minimum number of citizens. Under current rules, this amount is 0.5% of the votes cast in the last election for the Chamber of Deputies.
Currently, it is necessary to collect 491,967 signatures, in all states and in the Federal District, within two years from the opening of the process of creation of the party in the TSE. Due to the difficulties caused by the covid-19 pandemic, the deadline was extended by 120 days, exclusively for subtitles that were already in training during the health crisis.
According to the TSE, there are currently 83 subtitles in the process of formation in Brazil, which already has 33 parties regularly registered and authorized to run in elections.
