The Supreme Court (TS) has rectified the sentence of the Provincial Court of Murcia that lowered the sentence of the manager of a hotel in the San Javier district of Santiago de la Ribera for the sexual harassment to which he subjected one of his workers. The Murcian court upheld the businessman’s appeal and reduced his sentence from the two and a half years initially imposed by a criminal court to one year in prison. Before the appeal of the Prosecutor’s Office, however, the High Court revokes the decision of the Court and once again raises the sentence of this businessman to two and a half years in prison.
The hotelier, who already has another previous conviction for sexual abuse, was in charge of an establishment in Santiago de la Ribera where the victim worked between the end of February and mid-March 2019. According to the sentence, from the first On the day the woman started working there, the defendant made all kinds of personal comments and innuendoes unrelated to the employment relationship, such as “you are very pretty, leave your partner and come with me. You can have a lot of things.”

In addition, the defendant approached his employee without a shirt or in his underpants and on two occasions he even touched her ass while she was working at the hotel. One of those touches, the sentence specifies, occurred in the establishment’s laundry when he approached with his shirt unbuttoned and told his worker that “women are here to be kept, they cannot be alone,” strongly grabbing her rear. . The other touching, as the resolution specifies, occurred in the ice chamber when the defendant told the woman to leave her partner and go with him while she touched his ass.

Based on these facts, the Criminal Court number 1 of Cartagena sentenced the businessman to two and a half years in prison for a crime of sexual harassment in competition with another of sexual harassment. In addition to the prison sentence, he was prohibited from approaching or communicating with the victim for three years and six months and the obligation to compensate her in 2,000 euros. In addition, it acquitted him of another crime of sexual harassment of which he was accused.
The Court reduced the prison sentence to one year but the Supreme Court has decided to re-fix the sentence imposed by the criminal court. In its resolution, it argues that this body opted for a prison sentence, and not a fine, assessing the seriousness of the facts and, in the second instance, the recidivism of the accused.
