The Superior Court of Justice of the Valencian Community (TSJCV) has agreed to process an appeal presented by a citizen in relation to the “inactivity” of the president of the Generalitat, Carlos Mazónand the Security and Emergency Agency before the recent DANA.
The Fourth Section of the Contentious Chamber has issued a resolution confirming the admission of the appeal against the Presidency of the Generalitat and the aforementioned emergency agency. In line with the contentious-administrative jurisdiction regulations, the court has decided to request the relevant administrative files from the organizations involved for review.
The Valencian lawyer Nicolau Work is the one who has filed the appeal admitted by the TSJ of the Valencian Community. Nicolau, known for his legal activism during the pandemic, then filed numerous claims in court questioning the health measures.
Although the majority did not prosper and the Supreme Court endorsed the mobility restrictions implemented by the central government, Nicolau has continued with similar initiatives. Thus, he has also presented an administrative appeal to the Supreme Court for what he considers the “inaction” of the Government in responding to the emergency caused by DANA.
In addition, another similar lawsuit was submitted to the Supreme Court this Wednesday. The latter, raised by the Liberum associationalleges lack of action on the part of the Government of Pedro Sanchez in relation to the serious floods that affected the region. The association directs its appeal against the Government Delegation in Valencia, and the TSJCV referred the case to the Supreme Court considering that it is the competent body for its evaluation.
