The Murcia City Council will go to court to defend itself against the “false accusations” that, it claims, the lawyer of some of the relatives of the victims of the 'Atalayas tragedy' has leveled against the institution. In a letter addressed to the Murcia guard court, the lawyer José Manuel Muñoz – who represents four of the thirteen victims of the fire – warned this Wednesday of an alleged destruction of evidence of the fires in the Teatre and Fonda Milagros nightclubs by the Consistory. Some serious accusations that the City Council flatly denied. “This lawyer is making a tortuous manipulation of facts that have no connection in time, nor any relation to the case of the Atalayas fire,” municipal sources stressed.
The origin of this conflict is found in the complaint for alleged prevarication in the management of the fire that this party filed against two councilors and three officials of the City Council – among them the head of the Civil Protection and fire prevention service. Recently, the Court of Instruction number 4 of Murcia decided to initiate proceedings and transfer it to body number 3, which is the one processing the main case in this matter. The judge in the case already made it clear, in a recent resolution, that, in her opinion, the municipal action did not constitute a crime.
Muñoz maintains that, as a result of these judicial movements, he has learned that the Civil Protection service was destroying documents related to the management of that fire and the events of that fateful morning. For this reason, the lawyer asks the court to order the appearance of the Police in those offices for the “removal and custody of the shredded documentation.”
The City Council announced yesterday that it will take legal action against the lawyer's “false accusations.” The Murcia City Council assured that “no document related to the Teatre file has been destroyed.” In addition, he explained that the bags with shredded papers are not current, “they correspond to last February 9, 2024.”
