The head of the Court of Instruction number 3 of Murcia, which is investigating the Atalayas tragedy, has agreed to postpone for one month the authorization for the demolition of the warehouses where the Teatre and Fonda Milagros nightclubs were located, in whose fire 13 people died. The magistrate thus responds to the request expressed by some lawyers for the private accusations, who represent relatives of the victims.
These parties will have, as they had requested, a period of one month to order the carrying out of expert tests at the facilities, “upon announcement for the purposes of ensuring the presence of police members in order to guarantee security and authenticity measures.” ». The judge explains that this measure is adopted “in order to reconcile the right of the parties to obtain expert recognition and the obligation to safeguard the safety of citizens in the face of the potential danger that comes with keeping the aforementioned ships declared in a state of emergency. of imminent ruin.
The judge rejects, on the other hand, requiring the City Council to declare the building in a state of ruin, understanding that it is not necessary to clarify the facts “from the moment in which the police visual inspection report of the buildings is already available.” , and in any case, the parties are granted a period of time to present relevant experts in order to safeguard their right of defense.
Finally, the judge does not accept the request of some lawyers to require the president of the Superior Court of Justice to appoint a lawyer for the administration of justice and a support official.
