The International Court of Justice, the highest judicial body of the UN, issued six provisional measures to Israel to “prevent a genocide” in Gaza in response to South Africa's demand. Although it has not yet ruled on the existence of genocide or ordered a halt to Israeli military operations, the measures seek to avoid irreparable damage. In this edition of The Debate we explore the usefulness and possible impact of these measures on Israel's current war in Gaza.
Among the six provisional measures is also that Israel do what is necessary to prevent a genocide, ensure that its Army does not commit genocidal acts and prevent and punish any comments that incite the commission of genocide in Gaza.
But will Israel comply? How useful are the rulings of the International Court of Justice? Does the reality of war on the ground change? We discussed it with our guests:
– Concepción Escobar Hernández, director of the International Humanitarian Law Study Center of the Spanish Red Cross, professor of Public International Law at the National University of Distance Education of Spain. She was also a member and special rapporteur of the United Nations International Law Commission.
– Jorge Contesse, lawyer and doctor of law, professor of International Law at Rutgers University in the United States.
