The complaint against former Minister Martín Villa for the death in 1976 of Teófilo del Valle at the hands of the Armed Police is admitted for processing

The Court of First Instance and Instruction number 1 of Elda (Alicante) has agreed to admit the complaint against members of the Armed Police and former Minister Rodolfo Martín Villa for a crime against moral integrity by an authority or official in relation to the death of the worker. Teófilo del Valle on February 24, 1976.

In an order dated October 11, which Europa Press has accessed, the judge has approved initiating preliminary proceedings and requesting the birth and death certificates of the defendants. The court gives three days to file the appeal for reform.

According to Acció Ciutadana contra la Impunitat del Franquisme (ACIF) – Platform for Support to the Complaint Argentina País Valencià, the complaint was filed on April 22 by Teófilo’s brother, José Antonio del Valle Pérez.

The complaint is filed against the authors and those responsible for the death in Elda of the young worker Teófilo del Valle due to shots fired by the Armed Police. The defendants are police officer Daniel Aroca Del Rey, Sergeant Laureano Ballesteros Carbajo, Captain Carlos Holgado Marín, former Civil Governor Benito Saez González De Elipe and the aforementioned former Minister Rodolfo Martín Villa.

The reported events, recalls the group, “occurred in the context of the harsh police repressions suffered by the workers of the Alicante footwear sector during the mobilizations of February 1976.” The murder of Teófilo del Valle “was the first violent death by the forces of public order, after the inauguration of the head of state of Juan Carlos I,” they point out.

The complaint has been prepared by the legal services of the association Acció contra la Impunitat del Franquisme, a member of Ceaquathe State Coordinator of support for the Argentine Complaint against the crimes of Franco’s regime.

ACIF highlights “the importance of initiating a criminal procedure that establishes the judicial truth of the crime in which an armed police officer ended Teófilo’s life by shooting him six shots in the back.”

“Achieving truth, justice and reparation for all those people who suffered repression in the fight for freedoms and against the dictatorship is essential to establish the historical truth, strengthen our democratic system and avoid the repetition of these crimes,” they assert in a statement.
