The number of appeals of cassation filed by the Attorney General of the Emirate of Dubai, Counselor Issam Issa Al Humaidan, before the Court of Cassation, reached 32 appeals against final judgments issued by Dubai courts during the past year.
Head of the Civil Prosecution’s First Division, Khaled Ahmed Zakaria, said that there are three appeals that are still circulating and pending before the Court of Cassation, while 29 appeals have been adjudicated with a 91% separation rate.
He added that the Court of Cassation overturned 23 of the appeals submitted by the Public Prosecutor, and they were resolved, pointing out that the number of appeals for discrimination in final civil judgments submitted to the Civil Prosecution during the past year amounted to 417, and the percentage of completion and implementation of appeals for discrimination appeals reached 417. In the interest of the law within 60 working days or less.
He pointed out that the total civil rights and lawsuits referred to the Civil Prosecution by the Dubai Courts for opinion, amounted to 1,033 cases during the past year, including 258 human rights cases of first instance, 411 personal status cases, 316 appeals, 17 civil personal status appeals of cassation, and 32 appeals submitted by Attorney General for the Legal Department.
He stated that the percentage of completion of intervention cases within the specified time amounted to 100%, explaining that according to Article No. 174 of the Civil Procedures Law and its amendments, the Public Prosecutor may appeal against final judgments issued in civil lawsuits of all kinds if the judgment included in its reasons a violation of the law or an error in its application. Or its interpretation and the litigants, parties to the legal action, benefit from this appeal.
The Public Prosecution also intervenes by expressing its opinion in civil cases related to the incapacitated, its litigants, absentees and missing persons before the courts of first instance and the Court of Appeal in Dubai Courts in accordance with the obligatory and permissive cases specified in Chapter Four of the Civil Procedures Law and its amendments.
