Court Investigates BRL 2.8 million paid to former Lava Jato attorney; he has until Wednesday (June 29, 2022) to present his defense
O TCU (Union Court of Auditors) resumed this Saturday (June 25, 2022) the process that investigates daily rates, tickets and gratuities of former attorney Deltan Dallagnol, now affiliated with Podemos. Minister Bruno Dantas’ decision was made after the STJ (Superior Court of Justice) determine the resumption of the investigation.
Dallagnol has until Wednesday (June 29) to present his defense in court. The TCU minister states, in the decision, that the process needs to be resumed as soon as possible because of the risk of prescription. Here’s the intact (128 KB) of Dantas’ decision.
Deltan is a pre-candidate for federal deputy. If he is convicted by the TCU, the former attorney may become ineligible under the clean slate law.
In its article 2, the law establishes that persons “who have their accounts related to the exercise of public positions or functions rejected due to irremediable irregularities that constitute an intentional act of administrative improbity and by an irrevocable decision of the competent body”.
The TCU that charges R$ 2.8 million from Deltan Dallagnol for amounts paid in per diems and trips to prosecutors during Operation Lava Jato. The case was revealed by Power 360 in February 2021.
O Power 360 sought out the former prosecutor to express himself, but did not get a response until the report was published.

“On the decision of the Superior Court of Justice (STJ), former Lava Jato prosecutor Deltan Dallagnol clarifies the following:
“1. The decision to allow the Federal Audit Court (TCU) to resume illegal proceedings against Deltan came from the president of the STJ Humberto Martins, after a succession of decisions favorable to Deltan, both in the 1st instance and in the 2nd instance, handed down by technical judges and tendered.
“two. Once again, the agility of the appeal and decision against Deltan, as well as its content, is surprising. What is under discussion in the suspension of the preliminary injunction favorable to Deltan is whether there is any serious offense or disturbance of social order or public interest, which clearly does not exist.
“3. The STJ’s decision did not touch on the merits of the case, in which there is already a judicial manifestation in the sense that the TCU procedure is illegal and abusive, and there are even indications of breach of impersonality (suspicion) of Minister Bruno Dantas, which characterizes political retaliation. for his work in the Lava Jato operation by a Minister who was at the pre-candidacy launch dinner for former President Lula.
