Despite this, competitors can benefit from a reduction in Google’s power, even if it is minimal. They are enthusiastic about the expected solutions: “I predict great benefits in returning Chrome to the hands of the community. Moderating that relationship with corporate leaders is always going to be a good thing,” celebrates Guillermo Rauch, CEO of Vercel, a company that develops tools for websites; many of which depend on search traffic and advertising revenue controlled by Chrome. For his part, Gabriel Weinberg, CEO of rival search engine DuckDuckGo, said in a statement that the government’s proposed remedies would “free the search market from Google’s illegal control and unleash a new era of innovation, investment and competition.”
The pitched battle of Google and the DOJ
Google’s legal dispute with the DOJ began under the first Trump administration in 2020. The federal government, as well as several states, accused the tech giant of using anti-competitive tactics to dominate the search market, suppressing Americans’ access to other search providers. Biden moved forward with the case and filed another of his own, accusing Google of “illegally monopolizing the advertising technologies that millions of websites and apps used to generate revenue.” Both cases remain unresolved, and it is unclear to what extent the Justice Department will maintain pressure on Google after Donald Trump returns to the White House.
During the election campaign, Trump made contradictory comments about the company. In October, he expressed concern about his power but suggested that imposing onerous conditions could hamper US efforts to achieve technological supremacy over China. Judge Mehta set aside almost two weeks from April to hear arguments from the Government and Google on the punishments imposed. The new Republican administration’s approach to Google should be more evident by then, and prosecutors may be less willing to defend the proposals released Wednesday.
In it blog Walker’s speech on Wednesday highlighted the potential ramifications of proposals that Trump might find concerning, such as halting investments in AI and appointing a Technical Committee of five experts to oversee Google’s compliance with corrective measures: ” And that’s just a small part of it. I wish we were making it up,” Walker warned the panel. The government aims to give users more choice about the search engines they use; wants to end Google’s partnership with Applewhich receives tens of billions of dollars in advertising revenue for making Google the default search engine on iPhones. Google has similar agreements with other companies, which would also be void.
Google would also have to change the way it gives preference to its own services on Android or else sell Android. The proposals require Google to provide advertisers with a stream of data that helps them analyze their purchases. To give competitors an advantage, the government wants Google to share its search index and the data it collects about users when determining which results to show. The argument is that potential rivals could then match the information advantage that Google has accumulated over decades by studying the behavioral patterns of its billions of users. Additionally, Colorado’s attorney general proposed in Wednesday’s filing that Google fund “reasonable, short-term incentive payments” to users who opt for default, non-Google search engines.
The list does not end with the sale of Chrome
Google will also be banned from launching a new browser or investing in search, advertising technology and artificial intelligence rivals for five to 10 years. The government says the restrictions would “spur innovation and transform the general search and text search ad markets over the next decade.”
Rauch, CEO of Vercel, believes Google is unfairly using Chrome to direct people to its chatbot of Gemini AI, as well as other services it owns, such as Google Docs, through a mix of nudges and incentives built into its search engine: “Google is accumulating all the advantages it can by monopolizing this very important piece of the infrastructure software“.
