A company filed a lawsuit against an employee who worked for it as a pilot, during which it demanded that the defendant pay her an amount of 289,000 dirhams and legal interest from the date of the claim until full payment, and obligate him to pay her compensation of one hundred thousand dirhams and oblige him to pay fees and expenses.
The company explained that the defendant was working for the plaintiff as a pilot and the work relationship ended and a settlement and a general discharge was made, after which an amount of 176,646 dirhams was transferred to the defendant, and an amount of 112936 dirhams was transferred to the defendant again, but the defendant then filed a lawsuit workers against the “plaintiff” company to claim his dues, ignoring what was transferred to him, and the plaintiff in the labor lawsuit was unable to submit the documents attached in this case.
Accordingly, the Abu Dhabi Court for Family and Civil and Administrative Claims dismissed the suit and obligated the plaintiff to pay fees, expenses and attorney fees. In the rationale for her ruling, she confirmed that the plaintiff in this case had demanded to deduct the amount in question before the labor court, and the labor court of appeal had examined the plaintiff’s request in this regard and had decided on it, and the issue raised before this court had been established between them by the labor ruling in a stable manner that prevents the return of Then the court decided to reject the plaintiff’s request in this regard.
The papers were also void of evidence proving the defendant’s mistake, especially since the labor court ruled for him the sums that the plaintiff compelled in this case after the labor court examined the plaintiff’s request for a set-off for what she transferred to the defendant and what is owed to him. Hence, this request, like the previous one, was established on an unfounded ground that requires rejection.
