Raül Romeva presides over the ERC foundation despite being disqualified

Former councilor Raül Romeva has presided over the ERC foundation, Fundació Irla, since January 2024 despite being disqualified by the procés ruling. The then republican government chaired by Pere Aragonès included it in the official registry that depends on the Department of Justice, despite the fact that a disqualified person cannot be part of the board of an entity of this type.

According to El Periódico and La Vanguardia, the Irla Foundation argues that they appointed him president after the agreement on the amnesty. The rule went into effect in June, but has not yet been applied. According to the Catalan Civil Code, a disqualified person cannot be part of the board of a foundation. A condition that could also affect Laura Borràs, whom Junts has placed as president of its new foundation. Although in the case of Borràs, the sentence is not final.

The sentence for his management at the head of the Institució de les Lletres Catalanes (ILC) is not final, but he is condemned for documentary falsification. Even so, others, after the Junts congress in which Carles Puigdemont assumed the presidency of the party that she held, have now placed her at the head of the foundation that the formation will have. If she ends up being its president, she will join the board of trustees.

Sources from the Department of Justice, which is now led by the socialist Ramon Espadaler, assure that they will prepare a report on the legal situation of all the foundations linked to the parties.

According to article 332-3 of the third book of the Catalan Civil Code, some of the conditions to be a patron of a foundation are not being disqualified from holding public office or managing property; as well as not having been convicted of crimes against property or against the socioeconomic order or for crimes of falsehood.
