The brand Mercedes was condemned by the Australian Federal Court upon payment of 8.49 million dollars (about 8.52 million euros), as a penalty for failing to customers an important and urgent communication relating to the safety of its cars. In particular, the German carmaker had not communicated the recall to customers quickly enough for the replacement of airbag ‘potentially lethal’, due to a malfunction.
This decision was mainly carried out by the local competition authority, theAustralian Competition & Consumer Commission (ACCC). According to Automotive News reports, the manufacturer has admitted to having disregarded the laws in force, omitting a quick communication regarding the airbags Takata. The Australian road safety authorities had requested the car manufacturer to resolve the problem as a matter of urgency, which evidently was not done properly.
As reported by 23 customers between July 2018 and March 2020, Mercedes had spoken of a purely precautionary recall, basically making it clear that airbags on cars had never caused major accidents. According to the ACCC, this behavior was unfair towards motorists, as the replacement of the airbags was instead defined as very urgent, because it could have led to fatal accidents or injuries to the occupants in the cars. Takata airbag defects would have caused as many as 33 deaths worldwide, and to date, recalls have reached one million vehicles globally, across various car brands.
The fine came as a result, given the evidence brought before the court by ACCC. The issue of recalls is very important for car manufacturersand usually Mercedes is the protagonist of frequent communications in Europe as reported by sites such as car-recalls.eu. The management of the various problems regarding the quality of the products and their reliability is an important part in the daily relationship with customers, and in this case, according to the Australian court, the service of the Stuttgart company did not appear in line with expectations.
