Blank or annulled votes are considered invalid and have no interference in the election, which only considers the valid ones.
The majority of null or blank votes do not cancel an election, according to the TSE (Superior Electoral Court).
These types of votes are considered invalid, and the Constitution and Electoral Code say that only valid votes will be counted for the results. That is, they are only counted for electoral statistics, but they do not interfere with the election, because they are discarded.
When someone nullifies the vote for one of the positions in dispute, this does not compromise votes in other names. For example, if someone votes for president, but cancels or votes blank for federal deputy, the 1st vote will be counted and the 2nd, discarded.
According to the TSE, during an election period, there is confusion about article 224 of the Electoral Codewhich talks about scheduling other elections if more than half of the votes in the national, state or municipal elections are considered null.
Other points of the law, however, explain the cases of nullity, as if there is fraud in the votes, for example.
Valid votes are only those that go to a candidate, not including blanks and nulls. This Sunday’s election (2.Oct.2022) is for state, district, federal deputies, senators and for the 1st round of disputes for governors and president of the Republic.
Voting hours are from 8 am to 5 pm Brasilia time.
