The president of the Supreme Court and the General Council of the Judiciary stood up early this Sunday night after verifying that there was not going to be a renewal pact this week either, despite his reviled efforts to unblock the situation. Lesmes, through an official statement from the CGPJ issued shortly before 8:30 p.m., announced that this Monday his resignation from office after his efforts over the weekend have been unsuccessful. His resignation will be effective once the corresponding Royal Decree has been published in the Official State Gazette.
Although the possibility of Lesmes postponing his departure until October 13 had been considered, when a new plenary session of the Judicial Power is convened, the still president of the CGPJ has decided to save himself the trouble of having to preside over the acts of October 12 in a situation so precarious
“Completed today (Sunday the deadline announced by himself to the members of the Council in plenary session on September 29 without the Government and opposition having reached an agreement for the renewal or return of powers to the governing body of the judges, Lesmes has decided to cease immediately in the functions that correspond to him legally, ”the statement literally read, sent along with a statement from the president himself.

The Judiciary recalled in the farewell statement that after the call made during the opening speech of the Judicial year to Pedro Sánchez and Alberto Núñez Feijóo to put a “definitive solution to the unsustainable situation in which the Supreme Court and the CGPJ find themselves » and the exhortations to the same effect made by the Commissioner for Justice of the European Union, nothing has changed. “With all hope of rectification lost and in the face of the patent deterioration of the Supreme Court and the General Council of the Judiciary, which I cannot avoid, my presence at the head of these institutions is no longer useful and would also be contrary to my own professional conscience,” he wrote. the magistrate, who assured that having continued in office would only have made him an “accomplice” in a “situation that I abhor and that is unacceptable.”
Lesmes will immediately request to return to active service in the Judicial Career and will join his destiny in the Third Chamber of the Supreme Court, which already has 9 vacancies and thus, before the next retirement of one of its magistrates, he will be able to “Maintain at least for a time the essential minimum of members to constitute their prosecution sections,” said the Judiciary.
