The Court of Tarragona has denied amnesty to a computer scientist who faces a request for an 18-year prison sentence accused of having attacked the websites of several Spanish companies and organizations opposed to the process during the months after the referendum of October 1, 2017.
The amnesty has taken a backseat, but the courts continue to decide whether or not to apply it to citizens who are outside the political leadership but have been involved in criminal cases related to the sovereignty process.
Although the law, in force since last June, gave judges two months to apply it, the Tarragona Court did not resolve the denial of amnesty for this accused, one of those who face a greater risk of entering into prison, until last October 23.
In the order, advanced by El Nacional and to which elDiario.es has had access, the second section of the Tarragona Court, in accordance with the criteria of the Prosecutor’s Office, rejects the request for amnesty raised by the defense of the investigated person, Joel M. ., who is accused of several computer attacks carried out between December 2017 and February 2018.
The court, in a paragraph, reasons that although the events fall within the “time frame” provided for in the amnesty law, “these actions do not fit within the objective scope” of the law. The order can be appealed before the Superior Court of Justice of Catalonia (TSJC).
The other case in Spain that was being investigated against a hacker accused of actions in favor of the referendum ended up being archived.
