From the Ministry of Justice they specify what are the requirements to request this document
The certificate of crimes of a sexual nature is an official document that allows to prove that in the Central Registry of Sex Offenders there are no records that a certain person has committed this type of crime. This official document is issued in compliance with Spanish regulations and is only valid in Spain.
Organic Law 1/1996, on the Legal Protection of Minors, modified by Law 26/2015 and Law 45/2015, on volunteering establishes the obligation to provide negative certificates from the Central Registry of Sex Offenders for all professionals and volunteers who work in regular contact with minors. There are two ways to request this document, online or in person at the administration offices.
Who can request it?
Any natural person of legal age can request this certificate. Those minors, or with judicially modified capacity, must be represented by one of the parents or the legal guardian. Any citizen has the possibility to consult and obtain a receipt with the information that appears about his person in the Central Registry of Sex Offenders, in the section of ‘my personal data’ of the Citizen Folder service of the Ministry of Territorial Policy and Public Function, identifying himself by DNI-e or KEY.
Request for the certificate of crimes of a sexual nature
You can make the request and delivery of the certificates online through a valid electronic certificate. In this way you can avoid waiting and traveling to the Ministry of Justice and you can obtain the certificate at the same time of application. The Electronic Headquarters of the Ministry of Justice admits any electronic certificate of the @firma platform, the DNI-e and Cl @ ve PIN. You can request the Cl @ ve PIN from the Tax Agency so that it can be mailed to your home address.
The first thing you should know is that to do this procedure it is necessary to be registered in the Cl @ ve system or have one of the different electronic certificates of the @firma platform, such as the FNMT certificate, or the DNI-e. If you do not have one of these certificates, you can apply online and then go to the office closest to your home to prove your identity. To request the certificate online you must access the electronic headquarters of the Ministry of Justice, then you must press ‘Certificate of Crimes of a Sexual Nature’, and finally, the option of ‘online processing with Cl @ ve’ appears. Another option is to access the procedure through ‘Online processing without digital certificate’.
You can also find several offices of the Tax Agency, Social Security, Public Employment Service and Citizen Services offices of Government Delegations with a wide distribution throughout the national territory that can carry out the necessary identification to obtain electronic certificates. If the application is made in person, the certificate is normally issued on the spot. Remember that in certain cases, for example, technical incidents, it may be impossible and a longer period may be necessary, which in general will not exceed 3 business days. The Administration has a period of ten working days from its presentation to carry out the expedition.
The application must be submitted duly completed in capital letters and legible in the Territorial Managements of the Ministry of Justice or in the Government Delegations and Sub-delegations. Along with the application, it will be essential to prove the identity of the person requesting the certificate or also of another person if they represent them.
