In April, the Helsinki City Council approved a new site plan for Katajaharjuntie, which allows for new houses.
Two private individuals and one housing stock company appealed the city council’s decision to the administrative court – with little success.
Another of the individuals was of the opinion that the new formula put the area’s plot owners in an unequal position, as the building right effectiveness of the new plot was significantly higher than that of other plots in the area.
Another complainant was worried about how the new, taller Apartment Buildings would affect the living comfort and value of the neighboring houses.
According to the appellant, if the new house were to be built, there would be no more direct sunlight in his apartment than in June. The complainant was also concerned about the sufficiency of street parking spaces.
The housing association that was chosen was also worried that the five-story buildings would overshadow the housing association.
The building company appealed to the fact that with the new house, the conditions for a healthy and comfortable living environment would disappear from the neighboring property.
Administrative Court rejected the complaints, and for another private person, left the complaint unexamined because the complainant sent his counter-statement late.
The administrative court agreed that the plot efficiency of the new site plan was significantly higher than in the site plan valid in the area. However, it is an area of Helsinki where it is possible to reduce construction from the current level, and as such it was not against equal treatment.
According to the administrative court, the new building would cause some shadowing for the housing company that was selected, and the zoning had tried to address this by moving the new building further from the plot boundary than intended and by lowering the planned ceiling height.
However, according to the administrative court, it was not an unreasonable harm to the neighboring plots.
Helsinki according to the city, demolishing the houses in Katajaharjuntie and building new, taller houses in their place has many consequences: the value of the plots will increase, the population of the area will increase by about 130 inhabitants, and at the same time it will also increase the amount of traffic.
