Hacking Compensation for less than 100 euros – Suffering bankruptcy estate offers settlement for victims of data breaches

The actual compensation to be paid for a bankruptcy estate depends on how much is left to be distributed in the estate in the end. According to the settlement proposal, compensation may be less than one hundred euros for an individual victim.

The amount remains so small because the assets of the bankruptcy estate are much smaller than the debts.

Trustee Nina Aganimov does not confirm HS ‘s information on the content of the settlement proposal, but states that so far more than half of the individuals claiming compensation have accepted the settlement.

“In bankruptcies, it is common for the final distribution, that is, what is actually paid to creditors, to be only a fraction of the established claim,” Aganimov says.

More than a thousand individuals have demanded compensation from the reception center, ie only a small proportion of the victims of data breaches. Police have estimated a total of 30,000 to 40,000 victims.

The Victim Support Service has received contacts from victims regarding the settlement proposal of the bankruptcy estate.

“Our employees have the impression that the callers have been confused about what the settlement proposal means and what they should do,” says the Crime Victim Support lawyer. Elisa Trejtnar.

The Victim Support Service does not take a position on whether victims should accept the motion.

However, the support service warns that the costs of the proceedings may exceed the possible compensation if no settlement is reached and the case goes to court.

“It is difficult to predict the cost of a lawsuit in advance. However, even if the client wins, it is good to keep in mind that if the bankruptcy estate disappears, it will have to reimburse the creditor’s litigation costs, which will reduce the estate’s assets and the distribution shares accordingly. This means that all creditors in the bankruptcy estate receive less, ”the Victim Support Service states on its website.

When The company filed for bankruptcy last winter, according to the application the company had an estimated EUR 2.2 million in assets.

“Debts still exceed many times the assets of the estate. The total amount of supervised debt currently exceeds EUR 20 million, which includes maximum and contingent liabilities. The debts are specified in the trustee’s distribution list, which is submitted to the district court for confirmation, ”says the trustee Aganimov.

Victims of hacking can also claim compensation from the perpetrator if they are held accountable for their actions. About 3,300 victims have so far reported to the police that they are seeking compensation in a possible future trial.
