The convicted beat the victim with the butt of a pistol to take away briefcases with jewels worth 130,000 euros
The Third Section of the Provincial Court has confirmed the sentence of four years in prison imposed on two men for their participation in the assault on a jeweler in Alcantarilla in the spring of 2012. According to the sentence, the two defendants hit the victim with the butt of a pistol and kicking him to snatch some briefcases in which he was carrying jewels worth 130,000 euros.
The two defendants, aged 46 and 48, were sentenced to four years in prison for a crime of robbery with violence and intimidation and use of weapons or dangerous instruments. The court also took into account that the procedure lasted for more than nine years and applied a mitigating factor of undue delay that reduced their sentence. Both, however, appealed the resolution before the High Court, defending their innocence and demanding their acquittal. A request that has not prospered.
The events date back to the afternoon of April 4, 2012 when, while one of the convicted remained in a car, the other defendant -accompanied by other people- approached the victim, who had parked next to his jewelry workshop in Alcantarilla . The affected person was about to take out of his car three briefcases with jewels worth 130,000 euros and a briefcase with 2,500 euros in cash. According to the sentence, while one pushed him, another hit him on the head with the butt of a pistol, kicking him afterwards that made him fall to the ground. They then snatched his briefcases and fled the scene.
The police investigation revealed that the car in which the robbers were traveling, and which was found on a street in Alcantarilla days later, was stolen. The sentence also obliges the defendants to compensate the victim for the stolen loot, of which the insurance only paid 72,900 euros.
