The athletes claimed that “there was misuse of his image in an advertising campaign” advanced by the financial entity on the occasion of the 2019 Copa América in Brazil. That is why they filed a lawsuit.
The lawyer who represents them, Hugo Amayatold EL TIEMPO the details in 2020: “On the occasion of the Copa América in Brazil, Bancolombia organized an advertising campaign as the official sponsor of the National Team in which, for the consumption of their cards, customers were entitled to some dolls of the players. As the Constitutional Court has stated, when the image of a person is used in advertising, it is mandatory to have that person’s written authorization. In this case, Bancolombia did not have the authorization of my clients. We know that it did for others. Yoreli Rincón and René Higuita did pay their fees,” he said.
The lawyer added: “We called them to a conciliation hearing, but the lawyer they sent arrived with instructions not to have any intention of conciliating, which is why the lawsuit was filed, accompanied by a precautionary measure.”
Ruling against former players of the Colombian National Team
The ruling indicated that, although there was use of the image of the athletes, no harm could be verified against them and the terms of the agreements with the Colombian Football Federation confirm this.
The lack of sufficient evidence and arguments would be the reason for the defeat of the former footballers. Former athletes will have to pay in total about 252 million pesos.
