Recently, the European consumer rights group, BEUC, filed a complaint with the European Commission, accusing Temu of “failing to protect consumers and using manipulative practices that are illegal.” Specifically, mention is made of the use of “dark patterns”, and an investigation is already underway.
As if that were not enough, 17 European Union countries, including France, Germany and Spain, have also demanded investigations against Temu before national authorities. Here, it has been mentioned that China’s enforcement is distorting or harming consumers’ ability to make “free and informed decisions”” while shopping online.
This is a violation of the European Union’s online content law, known as the Digital Services Act. (DSA). In this regard, a Temu representative issued the following statement regarding the ongoing investigation:
“As we identify areas for improvement, we look forward to working together to improve our service and rectify any deficiencies.
“We are committed to transparency and full compliance with all applicable laws and regulations.”
This is not entirely new, as German consumer groups warned Temu earlier this year about similar issues, prompting the platform to announce that it would no longer display aggressive ads. The European Union joins territories such as the United States and Asia in presenting strong investigations against Temu for its consumer practices, as well as misleading advertising.
