That these devices were actually installed is not in doubt, but according to what reported by Autonews the real heart of the matter is still being examined by the court of Stuttgart is whether Mercedes-Benz knowingly deceived its customers by manipulating these devices, thus becoming worthy of complying with the claims, or whether this manipulation took place unintentionally. This class action aims to set a precedent that would allow the owners of SUV GLC and GLK to get compensation: we are talking about a lawsuit covering over 50,000 cars, and it was triggered by the VZBZ after Germany passed a law in 2018 that allowed consumer protection organizations to promote litigation on behalf of consumers they represent by avoiding the high legal costs that could discourage them from taking such an action.
Mercedes-Benz has made it known that the customer’s allegations, as well as the class action brought by the VZBZ, are unfounded, and confirms this that more than 25,000 such requests have been brought before the courts and in 95% of cases they were rejected.
