The Court of Appeal decided not to grant further leave to appeal in the case of the dissolution of United Brotherhood. Authorities are working to shut down the motorcycle gang Cannonball next.
Helsinki the Court of Appeal has not granted further processing permission in the case of the dissolution of the criminal gang United Brotherhood. In practice, this means that the legal battle has been decided and the decision of the district court to dissolve the gang remains in force, unless the appellate court’s decision is appealed to the Supreme Court.
“No further processing permit will be granted. The decision of the district court will remain permanent, ”the Helsinki Court of Appeal states in its decision.
The decision is historic in the sense that before the United Brotherhood, the court had not previously ordered the actual criminal organization to be dissolved in Finland. The decision also applies to the United Brotherhood’s subgroups Bad Union.
Court of Appeal the decision briefly recalls the conditions for granting a further processing authorization and states that they do not exist.
The court held that, on the basis of a mere reassessment of the evidence, there is no need to grant permission for further processing if there is no reason to doubt the accuracy of the district court’s outcome.
“The Court of Appeal has examined the grounds for granting a further processing permit. There is no reason to grant a permit, ”the court states in its explanatory memorandum.
CIRCUIT COURT considered the United Brotherhood (UB) and Bad Union (BU) an organized group to commit serious crimes. According to the law, they were hierarchically organized, had external characteristics, and were armed.
“The activities of UB and BU have clearly been flagrantly contrary to criminal law, as evidenced by the numerous convictions for serious crimes mentioned above,” the district court found.
The District Court also held that it was shown that Tero Holopainen was leader of the United Brotherhood and Bad Union. Holopainen himself denied that he had been a member of the gang during the winding-up proceedings.
Holopainen denied that the group’s activities had a criminal purpose or that the group was armed. Holopainen also appealed to the gang itself announcing the cessation of its activities. However, according to the district court, UB’s activities had not ceased.
Based on the district decision, it could already be predicted that similar lawsuits could become a new tool for the authorities in the fight against gang crime. At the moment, the authorities are demanding the abolition of the motorcycle gang Cannonball.
United Brotherhood is the first criminal gang to be disbanded, but the neo-Nazi organization Nordic Resistance has also been disbanded in violation of the law and good manners.
The Supreme Court held that the objectives of the neo-Nazi organization were contrary to the principles of society enshrined in the Constitution and the Penal Code.

Prior to the Nordic resistance movement in Finland, the association had been ordered to be dissolved in the 1970s on similar grounds.
