Mexico City.- The Employers’ Confederation of the Mexican Republic (Coparmex) made an “urgent” call to the INE and the Electoral Tribunal to stop a qualified majority in the Chamber of Deputies of Morena, PVEM and PT.
To this end, he asked the electoral advisers not to make a restrictive interpretation of Article 54 of the Constitution, and to ensure that the 8 percent overrepresentation is applied by coalition, not by party.
In a public letter signed by Coparmex at the national level and its subsidiaries in the 32 entities, as well as by the National Council for Strategic Litigation, México Evalúa and Mexicanos por México, they warn of a setback in democracy.
They insist that the spirit of Article 54 of the Constitution is to maintain plurality in the Chamber of Deputies and the rights of minorities in political representation.
“If a single party controls both the Presidency of the Republic and Congress through excessive overrepresentation that harms minorities and undervalues their votes, rights are compromised and the concentration of power is encouraged, limiting the balance and counterbalance necessary in a State of Law.
“We recognize the victory of the virtual president-elect Claudia Sheinbaum Pardo and we are clear that the electoral processes of June 2 are a reflection of the will of the citizens,” they indicate.
However, they point out that in the composition of the Chamber of Deputies they do not agree with applying overrepresentation by party.
The electoral authority, they say, has made a broad interpretation in other aspects, without any party objecting, so now it must do the same.
For example, they indicate, INE considers a coalition as a single political unit to limit campaign expenses, so it is “logical and coherent” that the same reading applies in this case.
“We support and join the voices of legal specialists, asking them to make a legal, historical, teleological, guarantee-based and systematic interpretation of Article 54 of the Constitution.
“It is crucial that electoral authorities review the Constitution as a whole and not just one word or one article. A proper interpretation will avoid regression to times when control by a single party prevented sufficient representation of the opposition and therefore reduced and affected democratic life in our country,” they add.
Allowing Morena and its allies to control 75 percent of the House when they won with 54 percent of the vote would demonstrate that votes do not cost the same.
The “4T” would have one deputy for every 80 thousand votes and the opposition one for every 200 thousand votes.
They warned that the impact on the country would be atrocious, since the opposition would not be able to present constitutional controversies and the new president would make reforms without any restrictions.
“We reiterate our urgent call for you to act responsibly and with commitment in the defence of democracy and electoral justice.
The decision you make in the allocation of seats will mark the course of the country and may open the door to a change of political regime by a majority that, although it won the elections, did not have a blank check in the vote for the integration of the Chamber of Deputies,” they added.
