The Civil House of the Presidency of the Republic gathered opinions from all Ministries and federal government bodies interested in recreating the Commission on Political Deaths and Disappearances of the Dictatorship (CEMDP), but has no forecast of when it will send the draft decree for the president’s signature. As the newspaper showed, the Lula government has been delaying the re-creation of the commission that was abolished by former president Jair Bolsonaro (PL). When questioned in March this year, the Civil House said that the proposal needed to go through different phases of discussion. At the time, the department headed by Minister Rui Costa (PT) had already received favorable opinions on the re-creation of the Ministries of Human Rights, Defense, Justice and the Attorney General’s Office (AGU).
The Civil House, however, claimed that the opinion presented by the Ministry of Justice during the administration of Flávio Dino, current minister of the Federal Supreme Court (STF), was no longer valid. “It is necessary to wait for the statement from the new head of the Ministry of Justice and Public Security (Ricardo Lewandowski) regarding agreement with the proposed content”, claimed the ministry. The current minister took office on February 1st of this year.
The department linked to the Presidency also said that an “internal assessment of the acts previously developed by the Commission will be carried out, until its extinction”. According to the Civil House, the procedure aims to “assist in the development of an action plan that could, eventually, guide possible future work of the Commission”.
“Any matter under discussion in the government has its procedural rite and needs to go through different phases of discussion. In view of this, it is incorrect to assume that a proposal upon reaching the Civil House will be automatically accepted without guaranteeing the possibility of broad expression from all actors involved”, said the Civil House regarding the need for a new opinion from the Court.
The management of the Minister of Justice. Ricardo Lewandowski, gave a favorable opinion to the re-creation of the commission last Friday, 26th. As shown in the Estadão, the Army also agreed to the return of the Commission and the resumption of investigations interrupted by Bolsonaro. There are no administrative steps left to be completed. It is now up to the Civil House to forward all the material to Lula and instruct him on what decision to take.
Officials from different departments involved in this process attribute the delay in recreating the Commission to the Civil House. The Commission had been causing apprehension in Lula. The president has committed to a policy of conciliation with the Armed Forces. An example of this appeasement strategy was the order given by the PT member last week to cancel all acts commemorating the 60th anniversary of the military coup.
The Commission was created during the Fernando Henrique Cardoso administration with the purpose of presenting answers to the deaths and disappearances that occurred between 1961 and 1979.
