Bill authorizes public authorities to share information obtained from the School Census and exams such as the Enem
The Chamber of Deputies approved this Tuesday (19.Apr.2022) a draft law that authorizes the government to share and make public data and microdata obtained from the School Census and student assessment exams. The proposal will be sent to the Senate.
Authored by deputies Tiago Mitraud (Novo-MG) and Adriana Ventura (Novo-SP)The PL 454/22 was approved with amendments by the rapporteur, deputy Felipe Rigoni (União-ES). Data obtained through evaluation systems and from all exams applied to students were included – initially, the original project only mentioned the Enem (National High School Exam).
The data collected in the School Census that may be shared includes information on basic education, youth and adult education, secondary education, higher education and other examinations or assessment systems.

Unlike the original project, the sharing and publication of data and microdata are authorized even without anonymization or pseudonymization until a common regulation by the ANPD (National Authority for Data Protection) and Inep (Instituto Nacional de Pesquisas Educacionais Anísio Teixeira) defines this requirement. The forecast is that the regulation will be made within six months from the publication of the law.
Anonymization prevents data from being linked to the person’s name. Pseudonymization is defined by the LGPD (General Data Protection Law) as a treatment through which a data loses the possibility of association, directly or indirectly, with an individual, if not through the use of additional information kept separately by the data controller. in a controlled and safe environment.
The PL also requires that, in order to make the regulation, these entities carry out public hearings and consultations, as well as regulatory impact analyses.
As long as the regulation does not come out, no restriction can be imposed on the sharing and publication of data and microdata collected both through the School Census and by exams and evaluation systems, being prohibited the suppression of those that were disclosed until the date of publication of the future law.
