The State Council canceled the part of the “fuel decree” of the Ministry of Business and Made in Italy regarding the average fuel price. This decision follows that of TAR of Lazio which had canceled article 7 of the same decree, which imposed the obligation to display the poster with the regional average prices in fuel sales points.
Average fuel price and the Council of State
The State Council rejected the obligation to display signs with average fuel prices, canceling article 7 of the decree of the Ministry of Business and Made in Italy of 31 March 2023. This decision was taken following the appeal presented by Mimit, but partially accepting the requests of Fegica And Figiscassociations of petrol pump managers.
The State Council stated that the requirement to update average fuel prices on a daily basis is unreasonable and disproportionateas consumers can already access more detailed information via the Ministry website or dedicated applications. The ministry is now called upon to identify more appropriate measures without excessively burdening fuel distributors.
In December, the Council of State had temporarily restored the obligation to display the average prices of petrol and diesel, suspended by sentence of the TAR of Lazio which had annulled the ministerial decree on fuel cartels. In fact, the TAR had expressed its opinion after appeal presented by Fe.Gi.Ca. (Federation of Fuel and Related Plant Managers), FIGISC (Italian Federation of Road Fuel Plant Managers).
The Ministry evaluates other solutions
After the latest ruling from the Council of State, the issue now returns to the hands of the Ministry of Business and Made in Italy, which is already working on the reformulation of article 7 to provide for a different cadence. Petrol pump managers' associations, such as FIGISC And Fe.Gi.Ca.welcomed the decision of the Council of State, underlining the victory of the category's rights and inviting the ministry to collaborate to find compatible solutions without resorting to arm wrestling.
According to the Ministry, the rule on displaying the average regional fuel price had proven its effectiveness despite the geopolitical turbulencewith Italy recording lower prices and a stable gross distribution margin compared to other large European countries.
