Those who killed Samuel Luiz were a “human pack” that considered the young nurse “its prey.” The alleged murderers of the young nurse simply “wanted to see his blood and enjoy his humiliation.” This is how crude prosecutor Olga Serrano has described it in her final report in the trial for the crime committed in a drinking area in La Coruña that in July 2021 shocked all of Spain. In a forceful presentation, the representative of the Public Ministry has appealed to the nine members of the jury so that when they begin to put together “all the pieces of the puzzle” to issue their verdict, they will have always present to the victim: “Because only you are left to Samuel.”
The prosecutor, in the eighteenth session of the trial, which is hosted by the Provincial Court of La Coruña, has insisted on putting the five investigated in the same bag. TEveryone participated in an “essential” way in the crime in one way or another: “They were fully aware that with their actions and blows there was a high probability that he would die in an attack that lasted three minutes for 150 meters.”
The prosecutor emphasizes the duration of the attack, more than three minutes. AND During his speech, he urged the nine members of the jury to think about their favorite song: “Imagine being hit, mostly in the head, for the duration of that song you’re thinking about.”
For Olga Serrano, the forensic reports are crucial to conclude that it was a multiple assault. The autopsy ruled out that there was a lethal blow during the lynching, since it was clear that The victim’s death was the result of “a number of” punches and kicks.
Therefore, “we are facing a single group attack”, in which, as the DNA tests also showed, Samuel Luiz had no option to defend himself against that “pack” that made up at least seven individuals: the five who now sit on the bench of the Court, and the two young people who were already convicted of the murder in a separate trial because they were minors at the time of the events.
He therefore singles out the five for the crime, for whom he demands sentences of between 22 and 27 years in prison. And in her presentation before the jury court, the prosecutor He has given each of them a nickname based on their personality and involvement in the crime: Diego Montaña, “the alpha male that everyone follows”; Alejandro Freire, alias ‘Llumba’, “the leader’s lieutenant”; Catherine Silva, “the sweet girl Kathy, who was in a relationship [sentimental] toxic with the alpha male; Kaio Amaral, “the one who thought he was the first in the class”, and Alejandro Míguez, “the liar.”
The prosecutor has not changed a single comma of the legal classification of the crime for the five alleged suspects, a murder with teaching and treachery, to which she adds the aggravating circumstance of discrimination based on sexual orientation in the cases of Diego Montaña and Catherine Silva. And also adds the theft of Samuel Luiz’s mobile phone to Kaio Amaral’s credit. But what the prosecutor has done is add an alternative qualification for Alejandro Míguez and Catherine Silva, the only two who are on provisional release.
And it has an explanation. has put on the table an option B that would place these last two as “accomplices”, instead of as perpetrators, with the intention of tying their sentence in the event that the jury considers that Alejandro Míguez and Catherine Silva were involved in the crime, but without an “essential” role in it. That would slightly reduce their penalties.
