The Ministry of Social Security will “imminently” approve a special benefit for cessation of activity for self-employed workers affected by DANA, explain sources from the Elma Saiz department. The extraordinary aid from the so-called ‘self-employed unemployment’ will not require a “waiting period”, that is, the usual minimum contribution of twelve months to receive this social protection.
The aid will be approved shortly in a broader package of government measures to face the catastrophe, including labor-related ones, such as the right to teleworking and paid leave, which Yolanda Díaz’s team has announced.
“Self-employed workers may request benefits for cessation of activity from their mutual insurance company,” the Ministry of Social Security explains.
This extraordinary aid in the event of a catastrophe will allow those affected to receive a benefit for cessation of activity “without a waiting period, that is, even if they do not have the minimum period required to be entitled to it, which is normally twelve months.”
The amount of the benefit will be “70% of the regulatory base,” they add. This reference is similar to the contribution base, hence the importance of how much is contributed to Social Security, since then the benefits and social protection received depend on this amount.
It will not consume the right to dismissal in the future
Furthermore, “the days of benefit consumed are not counted for future situations (counter at zero) and, furthermore, this period is counted as quoted,” they explain from the Elma Saiz department.
These two exceptional elements (deficiency and zero counter) were already deployed in the cessation of activity due to the La Palma volcano catastrophe, these sources point out, to expand the right to receive aid by self-employed workers. .
As they have informed the Ministry, “the mutual societies will also reinforce the dissemination of the steps to request the cessation of activity, with the aim of sending this information to the affected self-employed workers in the area.”
Social Security reminds that self-employed employers can also request the application of an ERTE due to force majeure at the SEPE to suspend their staff. “With 100% exemption from Social Security contributions for companies and workers,” indicates the Ministry.
