Ciudad Juarez.– Judge Lorenzo Villar Chavarría brought to trial five men accused of the crime of kidnapping with aggravated punishment against a woman and her daughter; the victim’s family paid a ransom of almost 300 thousand pesos that have not been recovered, in addition to two vehicles, property of the offended parties, according to criminal case 5009/2024.
Both women were victims of acts of torture by the aggressors who originally demanded one and a half million pesos for their freedom, calling them “polleras,” while the aggrieved women maintained that they were not involved in this illegal activity and did not have that amount of money.
To force the older woman to “confess,” one of her ears was cut off in front of her daughter, while the daughter was burned with cigarettes on the chest and back in front of her mother; both were beaten and psychologically threatened with further harm and then murder, which diminished the life expectancy of both.
At one point, when the aggressors forced the mother to convince the family to pay the ransom, she asked her relatives not to pay anything because they were still going to be killed, as the probable kidnappers had assured them when they were tortured.
According to the social representation, these events occurred on August 4 when a group of men traveling aboard a Ford Lobo pickup truck intercepted a mother and daughter who were driving a Murano pickup truck and forced them at gunpoint to get into the pickup truck.
It was the brother and uncle of the victims who reported the kidnapping and the demand for a ransom of 1.5 million pesos.
The family handed over a payment of 295 thousand pesos in cash and two vehicles; however, the victims were not released and the kidnappers demanded another payment of 200 thousand pesos.
In an operation, investigative agents from the Model Unit for Attention to the Crime of Kidnapping of the State Attorney General’s Office located and rescued the victims on August 9, around 5 p.m. in the San Sebastián del Oeste Corrales, located on the highway to Casas Grandes at kilometer 33.
The women were guarded by César Gabriel FJ, Ricardo Daniel RV, Julio Adrián JM, César Alan CM, and Mauricio Antonio EB, the latter of American nationality.
The five were arrested in flagrante delicto in possession of a black Ford F-150 vehicle, which was used in the kidnapping, as well as two weapons for the exclusive use of the Army.
While the judge was presenting the facts, before issuing his decision, he observed Julio Adrián JM who was moving in the assigned place.
“Tell me, young man?” asked the judge.
“Is there no way I won’t be present?” Julio asked, annoyed.
“Yes, you may leave,” he replied to the judge as the accused stood up to leave the room.
“Wait for me, you can’t move like that, you’re in a hearing, you’re not in Soriana,” the judge stopped him, almost shouting.
“It just bothers me that,” Julio interrupted.
–Allow me a moment, you cannot speak if I do not give you authorization, that is why you have your lawyers, that is why you can challenge this type of resolutions that are issued. I cannot start talking to you, I am issuing a resolution where two women were deprived of their freedom and one of them had her ear cut off-, said the judge, already upset.
–This is not just any crime, it is not about stealing a chocolate, this crime (kidnapping) is one of the most punishable crimes under the law. You must pay attention to all of this to capture this information and then use the legal resources. What is the point of saying it is not true right now? Use all of this information and let your lawyer know so that she can enforce it with the legal resources. Do I understand? – the judge said in a raised voice.
“But it is better for you to be at the hearing and find out everything and capture all this information. Otherwise, how are you going to defend yourself if you don’t know what I said?” Villar asked the accused.
“I’m just hearing a complete lie,” Julio insisted, still upset.
“That’s why you didn’t understand what I said,” the judge retorted.
“It bothers me that I’m accused of something that’s not true. It bothers me what they’re saying to me,” Julio insisted.
–But imagine the victim, doesn’t it bother him that they cut off his ear? Doesn’t it bother him?
Imagine how she’s going to feel. You have to keep quiet, number one. Number two, I’m talking to you right now and I’m asking you not to talk. Okay, let’s continue,” said the judge.
“But it wasn’t me,” the accused interrupted again.
“It is not necessary that you have cut off the cow’s ear directly. The one who cuts off the cow’s leg is as guilty as the one who grabs it,” the judge said, his patience almost exhausted.
The judge then ordered the police officers to remove the accused from the courtroom, after being warned by his defense attorney that he should remain silent.
The judge also asked the other four detainees to sit in their chairs and pay attention. He also asked Mauricio if he wanted to say something, and he replied that he did not want to get involved in Julio’s actions. The judge then explained that his decision would be based solely on the evidence presented by the Public Prosecutor’s Office and the defenders during the hearings.
