At the beginning of this month around two thousand swiss women they joined together to report to his Government before the European Court of Human Rights by lack of actions undertaken in against climate changean omission that, they assured, you are putting your life at risk. And what do you think happened?
Imagine all the human rights that are violated daily in the world, leave the world in our country, and the vast majority of us remain motionless, indifferent to so many transgressions that, as the ladies argued, put the lives of millions of people at risk.
I understand that many people, the vast majority of Mexicans, are not in a position to demand respect for their human rights, but those of us who are healthy, well-fed, free, with a decent job and with the privilege of having different economic, social and cultural, we should follow the great example of these women demanding the human right that we all have to have a healthy environment.
The United Nations General Assembly declared on July 28, 2022, that everyone in the world has the right to a healthy environment.
At the time, all Member States affirmed that the Climate change and environmental degradation are the most urgent threats for the future of human beings, which is why all governments were asked to redouble their efforts to ensure that all people on the planet have access to a clean, healthy and sustainable environment.
With regard to Mexico, our Political Constitution recognizes in its article 4 the human right to a healthy environment for development and well-being: “Every person has the right to a healthy environment for their development and well-being. The State will guarantee respect for “This right. Environmental damage and deterioration will generate responsibility for whoever causes it in terms of the provisions of the law, and its applicable legal framework is composed of federal, state and municipal regulations.”
And there is a framework legal instrument, which is the General Law of Ecological Balance and Environmental Protection (LGEEPA), which establishes the distribution of powers between the three levels of government in the matter.
In fact, the concept of environmental responsibility was incorporated into our legal framework 11 years ago. Since 2013, the Federal Law on Environmental Liability established that the precepts defined regarding liability for the generation of environmental damage are independent of property damage.
It defines environmental damage as: “Adverse and measurable loss, change, deterioration, impairment, affectation or modification of habitats, ecosystems, natural elements and resources, their chemical, physical or biological conditions, the relations of interaction that occur between them, as well as the environmental services they provide”.
As you will see, we have enough regional, national and international legal instruments to demand the right that we all have to have a healthy environment and to stop getting sick and losing our lives for not having it.
According to WHO data, it is estimated that in Mexico every year 20,500 people die from diseases linked to air pollution, which is just one of the serious environmental damages we suffer.
So the question is: Why don't we do anything? Why don't we join thousands or hundreds of thousands like the Swiss ladies to show that our government is not only not guaranteeing us a healthy environment as established by all laws but apparently has been determined to damage it?
What happened to the lawsuit from the elderly ladies? Well, they obtained the first victory in history in this matter. The court ruled that the government had “breached its obligations under the Climate Change Convention” and that there had been critical gaps in policies to address climate change, including a failure to quantify greenhouse gas emissions that They warm the atmosphere when fossil fuels such as oil, coal and gas are burned.
In short, it concluded that Switzerland's “efforts” to meet its emissions reduction targets had been inadequate and ordered the Swiss government to take measures to remedy the deficiencies and pay KlimaSeniorinnen €80,000 to cover its costs and expenses.
It seems like a dream, and perhaps the new Swiss measures will not solve climate change or the 80 thousand euros of damage to women's health, but without a doubt this fact gives us a shock and reminds us that those of us who can do it must fight intensely. for us and for our children, so that our human right to a healthy environment is guaranteed. It is about our health, about our future, about life itself from beginning to end.
