The National Consumer Secretariat (Senacon), linked to the Ministry of Justice and Public Security (MJSP), announced that it revoked this Friday (19) the precautionary measure against “payment machine” companies.
The companies PagSeguro, Mercado Pago, Stone and PicPay were cited for suspending covert interest charges from consumers. The accusation came from the Brazilian Federation of Banks (Febraban).

After receiving clarification requested from the companies, Senacon understood that the operators are complying with the legislation and there are no reasons to maintain the precautionary measure.
“The companies represented presented the clarifications requested by this body and demonstrated that their business model observes the duty of information to consumers and allows price differentiation authorized by law”, informed the body.
In response to the accusations, PagSeguro told Senacon that Febraban's accusations are “misleading and untrue”. Mercado Pago stated that the modalities questioned are legal and practiced throughout the market. Furthermore, the suspension would harm small business owners and, consequently, consumers.
Stone reported that the payment solutions used by the company are in line with the market and allow retailers to differentiate the prices charged depending on the payment instrument and receipt period. The company also highlighted that it has an exclusive relationship with retailers and does not charge consumers.
PicPay said it complies with all consumer protection obligations and that the banks' actions have “competitive motivations”.
According to Senacon's decision, the measure may be reevaluated if new elements emerge.
