The impeachment request against Supreme Court Justice Alexandre de Moraes is signed by 13 deputies allied with former President Jair Bolsonaro (PL) who have already been cited by the judge in investigations being processed by the Court. In total, 152 members of the Chamber signed the request, filed in the Senate on Tuesday, the 10th.
All the deputies that are in Moraes’ sights are from the PL, the party of the former president. They are: Alexandre Ramagem (RJ), André Fernandes (CE), Bia Kicis (DF), Carla Zambelli (SP), Carlos Jordy (RJ), Eduardo Bolsonaro (SP), Eliézer Girão (RN), Filipe Barros (PR), Junio Amaral (MG), Luiz Phillipe de Órleans e Bragança (SP), Marco Feliciano (SP), Silvia Waiãpi (AP) and Zé Trovão (SC). Estadão contacted the 13 deputies, but did not receive a response.
Early last month, the newspaper S.Paulo Newspaper showed that Moraes’ office requested reports from the Superior Electoral Court (TSE) to support decisions against Bia Kicis, Eduardo Bolsonaro, Filipe Barros, Marco Feliciano and Junio Amaral. The use of the TSE was done without following procedural rules and is one of the issues that support the impeachment request against the minister.
Leaked conversations between Moraes’ assistant judge at the STF, Airton Vieira, and former TSE advisor Eduardo Tagliaferro show that the minister’s order was to collect publications that contained fake news about the 2022 presidential elections. According to the newspaper, the requests were made to support decisions of INQ 4,781, better known as the “fake news inquiry”.
“Good evening, Eduardo! How are you?! The Minister asked to check, as soon as possible, the social networks of the pro-Bolsonaro deputies (I am sending the names below), to see if they are offending Ministers of the STF, TSE, spreading “fake news”, etc., for the purposes of fines. He is in a hurry… Thank you”, says a message from Airton Vieira sent to Tagliaferro.
Deputy Luiz Phellipe de Órleans e Bragança, in turn, began to be investigated by the fake news inquiry in 2020. His inclusion in the investigation was due to posts with alleged misinformation and attacks related to the TSE.
Five deputies are being investigated for their involvement in anti-democratic acts
Of the 13 deputies targeted by Moraes, five are being investigated by inquiries that are looking into anti-democratic acts. The parliamentarians are: André Fernandes, Carlos Jordy, Eliézer Girão, Silvia Waiãpi and Zé Trovão.
Fifteen days after the coup d’état on January 8, Moraes ordered an investigation into whether Fernandes and Waiãpi encouraged vandalism against public buildings. The alleged incitement to the attacks is being investigated in the investigation into the attempted coup d’état, reported by the Supreme Court justice.
Two days before January 8, André Fernandes announced the protest that led to the coup attempt. “This weekend, the first protest against the Lula government will take place at Praça dos Três Poderes. We will be there,” he said. Fernandes also shared a photo of the door to Moraes’ robe closet, which had been ripped off by the vandals, with the caption: “Anyone who laughs will be arrested.”
Silvia Waiãpi, in turn, posted videos of the attacks on her social media. In one post, she stated that the “people” were taking power.
“People take over the Esplanada dos Ministérios this Sunday! Seizure of power by the Brazilian people dissatisfied with the red government,” said the parliamentarian.
In July of last year, Moraes authorized the Federal Police (PF) to investigate whether Eliézer Girão “anticipated” the attempted coup d’état on January 8th a month before the attacks on the Three Powers. He is also being investigated in the inquiry that is looking into the invasion of public buildings.
Girão’s inclusion in the investigation into the attempted coup was motivated by a series of posts he made between November 2022 and January 2023. According to the PF, the posts indicated that the congressman incited hostility between the Armed Forces and republican institutions. In one of the messages, he wrote: “The People’s House belongs to the people. Brazil belongs to Brazilians. Justice belongs to God. #Let’sWin”.
Zé Trovão, in turn, is being investigated in the inquiry into anti-democratic demonstrations on September 7, 2021. The Bolsonarist was arrested in October of that year, after Moraes pointed out that he was organizing a truck drivers’ uprising that would result in violent demonstrations on the Independence holiday.
In January of this year, Moraes authorized the launch of a phase of Operation Lesa Pátria, which investigates the actions of financiers, executors and promoters of the attempted coup d’état after the 2022 elections. Carlos Jordy was the main target, after the PF suspected his involvement in anti-democratic acts that occurred in Rio after Bolsonaro’s defeat.
Illegal espionage and hiring of a hacker to invade CNJ
The PL candidate for mayor of Rio, Congressman Alexandre Ramagem, is the main target of the Supreme Federal Court investigation that is looking into whether the Brazilian Intelligence Agency (Abin), the agency he headed during the Bolsonaro administration, was used to spy on opponents of the former president. According to the findings of the PF’s Operations Close Surveillance and Last Mile, the agency illegally monitored Supreme Federal Court ministers, journalists and opponents of the former president.
Carla Zambelli is being investigated in the investigation into the attempted coup and the hacker invasion of the National Council of Justice (CNJ) system, which was allegedly planned as a pretext to question Brazilian justice.
According to the investigation, Zambelli hired hacker Walter Delgatti Neto, alias “Vermelho”, to insert false release warrants and an arrest warrant against Moraes into the CNJ system. In the case of the attempted coup, Moraes ordered the Federal Police in July of this year to investigate whether she had brokered the trip of a digital influencer to Spain, where she had a conversation with Venezuelan military officer Hugo Carvajal, a former agent of former Venezuelan dictator Hugo Chávez.
