This Thursday’s statement by businessman Víctor de Aldama, alleged ‘obtainer’ of the Koldo casebefore him judge Ismael Morenoin the National Court, will soon reach the Supreme Courtto the Second Chamber, which is investigating José Luis Ábalos, former Minister of Transport and now deputy of the Mixed Group, as a judge.
Aldama, former president of Zamora CF, has accused Ábalos of the crime of receiving bites; specifically 250,000 euros, in addition to enjoying a luxury house in Cádiz, acquired by people you trust. All of this, within the framework of the mask deals that Aldama’s company managed to close with various public administrations, including the Ministry of Transportation, where Ábalos’ advisor, Koldo Garciafacilitated contacts and opened the doors to other ministries and to Governments of the Canary Islands and the Balearic Islands.
“I deny how many defamatory accusations have been made today about me by Mr. Víctor Aldama (…) I will fully respond to each of them in court when I am questioned, something that I already requested without success weeks ago before being raised the case to Supreme Court“, stated in a statement sent by José Luis Ábaloswhich also indicates that “in parallel, I will study the exercise of criminal actions against Mr. Víctor de Aldama given the seriousness and falsehood of his accusations.”
Aldama has complaints coming up. Not only those announced by former Minister Ábalos, but also those that others of those mentioned in their voluntary statement this Thursday may present against him.
The President of the Government, Pedro Sanchezand the Secretary of Organization of the PSOE, Santos Cerdanare names that Aldama has repeated before the judge. He has attributed to the latter having collected 15,000 euros; money that Aldama provided at Koldo’s request for Cerdán, according to the businessman.
Santos Cerdan has denied this point. “It has no credibility,” said the socialist leader. “He is in preventive detention, he has attacked everyone, without evidence and with lies,” he added. Cerdán has highlighted that Aldama “has no relationship” with Sánchez. Not with himself either. “I don’t even know him, he can never say that he has been with me,” he added.
Only those concerned can report
The PSOE has announced criminal actions against Aldama, however, they can only be brought by those directly referred to, who can file complaints for slander or insults, legal sources inform this medium.
He crime of slanderincluded in articles 205, 206 and 207 of the Penal Codeconsists of the imputation of a crime made with knowledge of its falsehood or reckless disregard for the truth.
It is punishable by between six months and two years in prison or a fine of twelve to 24 months, if they are spread with advertising and, otherwise, a fine of six to 12 months.
Article 207 of Penal Code establishes that the person accused of the crime of slander will be exempt from all punishment by proving the criminal act that he has charged.
The sources consulted indicate that in this case Aldama’s statement has been made with publicity, since he was aware that his statements would later appear in the press and the secrecy of the proceedings has not been decreed.
Insults regarding Sánchez
Insults, as a crime against honor, are produced by actions or expressions that harm the dignity of a person, undermining their fame or attacking their own self-esteem.
In this sense, Victor de Aldama has said regarding the President of the Government, Pedro Sánchez, that he was the one who asked to take the photo, in 2019, in which they are seen together, recently published by The World. It was in a PSOE event where Pepu Hernández’s candidacy was presented. Aldama has said that in a brief meeting in a booth at the La Latina Theater in Madrid, Sánchez told him: “Thank you for what you are doing, you have kept me informed.”
Aldama has stated that it was Koldo and Ábalos who summoned him at that event and that Sánchez’s gratitude referred to his intermediation in Mexico, in an AENA matter.
For its part, the PSOE denies this and says that the photo was taken by chance.
Sánchez has referred to Aldama as an “alleged criminal.” “He deserves the credit he has: none. It has to be Mr. Aldama who proves these insinuations and accusations. I can guarantee you that we are calm, with regard to myself, the Government and the PSOE, everything that this man has said is categorically false,” he stressed.
For his part, the Minister of Territorial Policy and Democratic Memory, Ángel Víctor Torresformer president of the Canary Islands, has also been cited by Aldama, who has said that he asked for 50,000 euros in the context of the purchase and sale of masks.
