Activate the legislation
Legal Adviser Dr. Abdul Rahman Suleiman believes that these negative phenomena can be avoided by activating legislation that prevents the conduct of any business or advertising for business without the person who initiates these advertisements having a specific license, pointing out that licenses are issued by the economic development departments in all the emirates of the country, according to Geographical or spatial space, and therefore no person may collect sums of money through the travels, by inviting him to employment or recruitment officials unless he has a license from the competent economic department in the concerned emirate in which the advertisement can be or the person can be employed The concerned person, noting that any action otherwise causes the declared person to be held accountable and in violation of the law and makes him liable to trial before the fair Emirati judiciary.
He added: “The issue may need to be rooted, so that it shows the legal articles that prevent starting a business without a license. In addition, the local legislation in the UAE prohibits the practice of any work unless it is authorized and issued under the activities as an activity of employment, recruitment of labor or employment, whether the person is natural, legal or legal unless he has obtained a license to do so from the competent authority.
Legal Counsel Moataz Fanous believes that recruitment fraud is the third most popular fraud after bank fraud and malicious links fraud. Those with experience in the same specialization obtain it, or they send an e-mail claiming that the sender is an employer or an agent for an employer who submits a job offer for a job to a job seeker who has not already applied for it! Pointing out that there are many examples in this matter. The job seeker must be aware and not be tempted to send money or fees, or ask him for information about his bank account, because in this case he will fall into a major catastrophe.
Many victims suffer from depression and health problems.
The UAE legislator also clarified in the Penal Code the penalty for fraud, which means “the appropriation of others’ money using fraudulent methods with the intention of owning it.”
He also warned those who are about to work not to accept receiving any money transfer from the alleged recruitment company for the purpose of delivering it to a third party in return for hiring him, because this would expose him to legal accountability, as he committed a money laundering crime from where he does not know.
Fanous explained how to get rid of these fake job sites:
First: Examining the content of these jobs, and this is done by checking the e-mail of the person who sent you the e-mail, whether it is a personal e-mail or an e-mail that ends with “ae”, that is, it is an official e-mail, and checking the method of writing the e-mail that should It is clear and professional and ends with the person’s name and phone, and when in doubt, please do not deal with these sites and inform the competent authorities to do what is necessary, so that the notification is made through the nearest police station or through the “eCrime” platform of Dubai Police, or the safety service – Abu Dhabi Police, or Through the use of the smart application «My Community is Safe».
Fanous appealed to community members to check virtual sites, pointing out that the most important rule if you are asked for sums of money in exchange for a job, do not respond and ask the people of law to protect you from the clutches of criminals, because the UAE Labor Law Article 18 of it states that no recruitment company has the right to ask Commission, fees or material reward from job seekers in return for arrangements to find a job opportunity for them, and the agent is not entitled to receive any fees or costs, except for those specified by the Labor Law.
The same article also states that the relationship between the employer and the employee must be direct without the intervention of the recruitment company after the agent arranges a meeting between them. Hence the importance of spreading legal awareness, for the benefit of society, especially university students and recent graduates, because they have a great passion for a job that puts them on the first degree of achieving their professional and personal ambitions.
He suggested raising awareness among university students of different specializations, so that they do not fall easy prey to fraudsters. Legal Adviser Salem Saeed Al-Hayqi, CEO of Vision Advocates and Legal Consultants, believes that a job is the dream of every young man and girl after graduation, and not getting a job leads to frustration with a lack of opportunities, especially after the spread of the Corona pandemic (Covid-19).
In this period when the job-seeker is attached to any hope, the savior, the representative of the fictitious company, appears, the fraudster who plays a psychological role of great influence in creating hope for the victim, who is ready to cling to any hope, even if it is an illusion.
The fraudster takes several forms of persuasion to inflict victims and seize their money, and these fraudsters often take advantage of the basic needs of individuals, such as the need to find a job and a source of livelihood. From allowances, travel tickets, etc., it makes the researcher shocked about the salary and benefits that he will receive, and then the researcher asks the victim to pay a sum of money for various reasons such as recruitment fees, fees for arranging interviews or completing the appointment.
And all this is under the cover of a fake company that soon discovers after the victim falls into the trap that was set for him, and then the young man is shocked after learning that he has fallen victim to a planned and deliberate fraud.
The workers who are employed by the recruitment mediator or the supplier of workers immediately upon joining the work are considered workers with the employer, they have all the rights that the workers of the facility working in, and the relationship between them and the employer is direct without any interference from the labor broker whose mission and relationship with them ends as soon as they are submitted to the employer and their service.
Al-Hayqi suggests that all recruitment companies for UAE jobs be in the UAE, and be licensed and under the management and authority of the Ministry, provided that they are subject to evaluation periodically. There must be cooperation between the security authorities, the Ministry of Human Resources and Emiratisation, and the Telecommunications Regulatory Authority on banning fake websites.

How many job seekers have become victims of fake employment sites that have published their data and information without their knowledge or permission, pointing out that fake jobs have increased recently, given There is no deterrent or law punishing these companies that manipulate the future and dreams of job seekers. He called for raising the awareness aspect by the concerned authorities in the state, so that the individual would be more vigilant and cautious than before, and in order not to fall into the trap of a fictitious job.
Abdullah Al-Shihari believes that the fake job has spread frighteningly recently by the fake companies whose ambitions and goals do not stop at a certain ceiling, pointing out that if a company is suspended and the license is withdrawn from it, a new license is quickly opened with a new name, and herein lies the problem that needs to A formula that prevents such people from returning to their tricks and fraud. He called for the cooperation of all in order to contribute effectively to the knowledge of fictitious companies and to mitigate the impact of this phenomenon that has spread in societies.
