The UAE affirmed that peace and justice are two basic human values, and the desire for peace and justice is not limited to a region or people, but rather two universal goals stipulated in the Charter of the United Nations and the Rome Statute of the International Criminal Court.
In a statement to the UN Security Council on the twentieth anniversary of the Rome Statute on the relationship between the Council and the International Criminal Court, she explained that peace and justice are interlinked goals, and they reinforce each other.
“The UAE has always emphasized the importance of implementing international law, including international humanitarian and criminal law, and supports all efforts within the international legal framework to achieve peace and justice,” she added in the statement made by Mohammed Bu Osaiba, a member of the country’s permanent mission to the United Nations.
She stressed that the cornerstone in this framework is the primary responsibility of states in applying the law, preventing violations on their territory, and their legal jurisdiction.
“As we explained before, peace and justice are two interrelated goals that reinforce each other,” Bouassiba said in the statement, adding: “Achieving justice by ensuring accountability for violations not only restores the rights of victims and survivors, but also contributes to laying the foundations for peace through healing.” societies, push towards building peace and promoting reconciliation.
He added, “To this end, the UAE stresses the importance of adhering to international law, including international humanitarian and criminal law, and supporting efforts within the international legal framework to achieve peace and justice.”
He pointed to the role of the International Criminal Court within the international framework, stressing, according to the statement, support for the sovereign right of states to accept the jurisdiction of the Court, as the founding treaty stipulates in principle on the consent of states.
He noted that in order to implement the Council’s duty to maintain international peace and security, Council members must cooperate in order to prevent and stop violations.
Bouassiba stated, in the statement, that the referral to the International Criminal Court should not be seen as a decisive remedy, which was clarified by Article 16 of the Rome Statute, as it gave the Security Council flexibility in the performance of its tasks, by giving the Security Council the right to postpone an investigation or Prosecution by the International Criminal Court, in order to avoid any conflict between the interests of achieving justice and peace.
The Security Council should adopt a comprehensive approach to each situation, especially with regard to the practical implications and long-term priorities for reconciliation, stability and peaceful coexistence.
