The TRJRJ confirmed the request for a second Judicial Reorganization of OSX, by businessman Eike Batista, with Porto do Açu, controlled by Prumo, as defendant. He also informed that there is still no decision whether the request, made this Saturday, 20th, will be accepted or not. OSX is the only company from the former EBX group that remains in Eike's hands.
The company's first Judicial Recovery began in 2013, resulting from debts of R$5.3 billion, and was concluded in 2020 in a creditors' agreement.
On October 13, 2023, OSX received a notification from Porto do Açu Operações expressing the closure of the “Standstill Period” celebrated between the parties on September 20, 2018. In a relevant fact sent to the Securities and Exchange Commission (CVM) ( CVM), OSX recalled that in the Standstill Agreement, Porto do Açu had agreed to refrain from adopting any measure to demand from the OSX Group any pecuniary obligations, due or unexpired, assumed by the OSX Group towards the company, including, among others , the rents due and falling due from September 2018 in relation to the area of Porto do Açu that the company occupies.
Since November last year, the company has been collecting a debt of R$403 million from OSX. In November, the judge of the 3rd Federal Business Court of Rio de Janeiro Alexandre de Carvalho Mesquita ordered an examination of OSX's accounting, which can now enter its second Judicial Reorganization.
According to OSX's results in the third quarter of last year, the company accumulated losses of R$621 million in the first nine months of the year.
