Dorothea “Coco” Fletcher embodies the 81-year-old on the show “Simply The Best – The Tina Turner Story” and can be seen on advertising posters. But the original Turner has nothing to do with the production and takes action against the use of her name and her “portrait”, as it is called. She sued the Bavarian tour operator for an omission and got her right before the regional court in Cologne. The higher regional court in Cologne conceded the verdict. So the case goes into the next round on Thursday (9 a.m.) in Karlsruhe. Whether there is already a judgment is open. (Az. I ZR 2/21)
Turner is of the opinion that because of the similarity between Fletcher and her, the viewer of the posters assumes that she herself is depicted on the posters. Tour organizer Oliver Forster from Cofo Entertainment from Passau, however, argued in Cologne that at more than 100 performances of the show in Germany, Austria and Switzerland, no viewer had subsequently complained that he had not seen the real Tina Turner .
Ultimately, it is about the legal question of whether in such a case freedom of art or the right to one’s own image and name weigh more heavily. Because this was unclear, the Higher Regional Court had admitted the appeal to the Federal Court of Justice. (dpa)
